  4. Products are mostly handmade; individual items may slightly differ from each other in terms of shape, color, or size. All detailed information about the Products is included in their descriptions available in the Store.
  5. These Terms and Conditions define the rules for using the Online Store, placing orders, delivering goods, making payments, the right to withdraw from the contract, the rules of the Loyalty Program, and the rules for submitting and processing complaints.

  2. Entrepreneur with consumer rights (PNPK) – a natural person concluding a contract directly related to their business activity, when the content of this contract shows that it does not have a professional character for that person.

  4. Sales Contract – a contract for the sale of Goods concluded remotely between the Customer and the Seller.

§ 3. Technical requirements and Electronic Services

  1. To use the Store and place orders, it is necessary to have: a device with internet access, an updated web browser with cookies enabled, an active e-mail account.
  2. The Seller provides free electronic services:
  • Customer Account – a service allowing for order management and participation in the LE SILQUE Club Loyalty Program. Creating an account is voluntary. Customers can log in using a one-time six-digit verification code sent to their e-mail address. The Customer can delete the account at any time by contacting the Seller.
  • Newsletter – sending commercial information, which the Customer can unsubscribe from at any time.
  • Shopping Cart and Order Form – a one-time service, which ends upon placing an order.
  • AI Assistant – a service enabling the User to obtain automated responses generated by an artificial intelligence system. The responses provided by the AI Assistant are automatic, informational, and supportive in nature, and are not the result of individual human analysis. These responses do not constitute legal, medical, pharmaceutical, cosmetology, or any other professional specialist advice, nor do they constitute a binding declaration of will by the Seller. The AI Assistant is not intended for submitting complaints, declarations of withdrawal from the Sales Agreement, requests, or other declarations addressed to the Seller. The User should not transmit sensitive data, special category data, confidential information, or other information whose disclosure could violate their rights via the AI Assistant.

§ 4. Placing orders and security

  1. Orders can be placed 24 hours a day, 7 days a week.
  2. After adding items to the cart, the Customer proceeds to checkout, provides shipping details, and selects the delivery and payment method.
  3. Clicking the "Buy and pay" button (or one of equivalent meaning) constitutes the Customer's declaration of will and is an offer to conclude a Sales Contract addressed to the Seller.
  4. Due to the system processes of the Shopify platform, a binding Sales Agreement is concluded only when the Seller sends a separate message to the Customer's e-mail address confirming the acceptance of the order for processing.
  5. The Seller proceeds to fulfill the order immediately after the payment is credited.
  6. Protection against fraud and system errors: The Seller reserves the right to cancel an order and immediately refund the paid funds in the event of a justified suspicion of payment fraud or in the event of an obvious system error (e.g., a gross pricing error that does not correspond to the actual value of the product).

§ 5. Payments and Invoices

  1. All prices in the Store are gross prices (include VAT). Delivery costs are added in the cart depending on the chosen method and order value.
  2. All prices given in the Store refer to one item of the product and are expressed in Polish Zlotys (PLN) or Euros (EUR), unless the offer description states otherwise.
  3. The price given for the product is binding at the moment the Customer places the order.
  4. The Seller is entitled to change prices; however, changed prices do not apply to orders placed before the price change.
  5. Payment methods: The following payment methods are available in the Store:
    • Electronic payments, online transfers, BLIK, and payment card payments via integrated payment gateways (e.g., PayU, Przelewy24, Shopify Payments, PayPal).
    • Cash on delivery (COD) – cash or payment card to the courier delivering the package.
    • The current list of payment service providers is presented each time at the order placement stage in the shopping cart.
  6. Payment deadline: In case of choosing upfront payment (prepayment), the Customer is obliged to pay for the order within 5 business days from the date of placing it. After the ineffective expiry of this period, the order will be automatically canceled.
  7. The Seller sends a VAT invoice covering the delivered Goods, in the form of an electronic file in PDF format, to the Customer's e-mail address provided in the order form or to the National e-Invoice System (KSeF).

§ 6. Promotions and Discount Codes

  1. The Seller provides discount codes in the Store as part of an organized promotion. The discount code is made available on the online store www.lesilque.com or in the Seller's advertising materials.
  2. Promotions in the Store are periodic. Promotions do not combine with other promotions, discounts, or discount codes.
  3. A discount code can only be used when purchasing Goods not covered by other promotions in the Store. Discount codes and promotions do not combine. Only one discount code can be used per order.
  4. The discount code is not exchangeable for money (cash) in whole or in part and cannot be returned to the Seller.
  5. The validity of the discount code will be determined each time at the moment of its publication. The code is active from the moment of publication and expires with the expiry of its validity period. The Seller has the right to refuse to fulfill the discount code after this period.
  6. The use of the discount code depends on the Customer's preference. To use the code, enter the given string of characters in the "discount code" field (or equivalent) in the shopping cart when placing the order. Entering the code reduces the value of the ordered goods by a percentage or monetary value.
  7. The discount code received by subscribing to the Newsletter is for single use only and does not combine with other promotions, discount codes, or markdowns in the Store.
  8. All complaints regarding product defects or returns for purchases made with a discount code and promotions will be considered under the general terms specified in these Regulations.

§ 7. Gifts for orders

  1. The Seller may organize promotional campaigns allowing for the selection of a promotional product (a "Gift") for a symbolic amount (e.g., 1 grosz) after the Customer exceeds a certain cart value in a single Order.
  2. The monetary thresholds entitling to a Gift (e.g., at least PLN 149, PLN 249, PLN 399) and the pool of available Gifts are specified each time on the Store's Website. Delivery costs are not included in the limit of the amount entitling to receive a Gift.
  3. Participation in the campaign is voluntary. Only one Gift can be received per Order. The campaign does not combine with other promotions available in the Store.
  4. The Customer will receive the Gift along with the order only if they independently and voluntarily select the Gift in the Cart when placing the order and add it to the order. The Seller does not automatically add Gifts to orders if the Customer does not do so at the cart stage.
  5. The Participant cannot exchange the Gift for another product or its monetary equivalent.
  6. In the event of the Customer being a consumer or PNPK withdrawing from the Sales Agreement (in whole or in part), which results in the value of the remaining goods falling below the threshold entitling to receive the Gift, the Customer loses the right to use the Gift and is obliged to return it immediately.
  7. If the Gift is not returned within 14 days of withdrawal, the Seller is entitled to demand payment from the Customer of the full, regular price of the Gift. This amount may be deducted from the amount returned to the Customer as part of the refund for withdrawal from the contract.

§ 8. Delivery of goods and free shipping

  1. Orders are fulfilled in Poland and the European Union.
  2. Shipping costs depend on the shipping method chosen by the Customer and the chosen courier company and are added to the order total. The Customer approves the shipping costs visible when placing the order.
  3. Order processing time (preparation and handover to the courier) is usually from 1 to 5 business days. The Seller makes every effort to ensure that order fulfillment does not exceed 48 hours – unless the parties
    have agreed otherwise.
  4. Free shipping: The Customer has the option to choose free shipping for orders whose value exceeds a specified monetary threshold (currently PLN 199 gross).
  5. Free delivery applies only to orders fulfilled within the territory of the Republic of Poland.
  6. Free delivery applies only to orders paid for in advance by the Customer (prepayment). Orders placed with the cash on delivery option (COD) are not eligible for free delivery and standard shipping costs are added to them.
  7. The Customer is obliged to examine the delivered parcel at the time and in the manner customary for parcels of that type. In case of finding a shortage or damage to the parcel, the Customer is obliged to demand from the Carrier's employee to draw up an appropriate protocol, necessary for the parcel complaint process.
  8. In the event that a parcel properly dispatched to the Customer is not collected by them, the costs of returning the parcel to the seller and re-dispatching it to the Customer shall be covered by the Customer.
  9. If an order placed by the Customer cannot be fulfilled due to the unavailability of a specific Product, the Customer will be immediately informed of this fact and will receive a refund of the amount already paid. If this is the explicit wish of the Customer, the Seller will indicate to the Customer the delivery date of the
unavailable Product, and if the Customer explicitly accepts such a date, the order will be considered valid, and only its fulfillment time will change accordingly. It is also possible, at the Customer's explicit request, to make other arrangements than those described above.

§ 9. Right of withdrawal (Returns)

  1. A Consumer and an Entrepreneur with consumer rights (PNPK) have the right to withdraw from the Sales Contract within 14 days without giving any reason, although providing one may be helpful in better adapting the offer to customer needs.
  2. The period for withdrawal begins on the day on which the Customer took possession of the Goods (e.g., picked up the package).
  3. To return an item, simply send a declaration of withdrawal from the distance contract (sample declaration available for download in the FAQ tab) to the e-mail address sklep@lesilque.com and send back the products.
  4. Return costs: In the event of withdrawal, the Customer who is a Consumer or an Entrepreneur with Consumer rights only bears the direct costs of the return. We refund the money after inspecting the returned goods, which must not be damaged or show signs of use, to the account provided by the Customer, within 14 days of receiving the returned goods.
  5. RETURNS AND GIFTS, FREEBIES AND PROMOTIONAL PRODUCTS:
    • If the Customer received a free product (freebie) or purchased a product at a symbolic promotional price (e.g., for 1 grosz) due to exceeding a certain order value threshold or as part of a points exchange in the LE SILQUE Club Loyalty Program, and then returns all or part of the order, causing the value of the remaining products to fall below this threshold (or the promotional conditions are no longer met), the Customer is obliged to also return this promotional product/freebie.
    • Otherwise, the Seller has the right to reduce the refund amount by the purchase price of the received gift (its regular market value).
    • An analogous rule applies to free delivery. If, as a result of a partial return, the order value falls below the free delivery threshold, the Seller has the right to deduct the standard delivery cost from the refunded funds.
  6. Possible costs related to a consumer's withdrawal from the contract, which the consumer is obliged to bear: • If the consumer chose a delivery method for the Product other than the cheapest standard delivery method available in the www.lesilque.com Online Store, the Seller is not obliged to refund the consumer for any additional costs incurred. • The consumer bears the direct costs of returning the Product. • The Seller does not accept cash-on-delivery shipments from Customers with returned products, nor shipments sent to parcel lockers.

§ 10. Exceptions to the right of withdrawal

The right to withdraw from a distance contract does not apply to the Buyer in relation to a contract:

  • in which the subject of the service is a non-prefabricated item, manufactured according to the Buyer's specifications or serving to satisfy his individualized needs,
  • in which the subject of the service is an item that deteriorates quickly or has a short shelf life,
  • in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.

§ 11. Complaints – Non-conformity of goods with the contract (For Consumers and PNPK)

  1. All complaints related to products purchased in the official LE SILQUE brand store at www.lesilque.com should be submitted in writing, to the address: GET GLOWING Magdalena Babska ul. Felińskiego 1/U1, 81-578 Gdynia or by e-mail to: sklep@lesilque.com, along with the order number.
  2. The Seller is responsible for any non-conformity of the Goods with the contract existing at the time of delivery and revealed within 2 years.
  3. The Customer has the right to demand repair or replacement of the Goods first.
  4. If repair/replacement is impossible or would involve excessive costs, the Customer may demand a price reduction or withdraw from the contract (refund).
  5. Complaints should be reported to the e-mail address: sklep@lesilque.com. The Seller will respond to the request within 14 days.
  6. The Seller allows for different, individually agreed upon with the Customer, at his explicit request, ways of settling complaints after their positive consideration.

§ 12. Warranty Claims (Only for businesses - B2B)

Pursuant to Article 558 § 1 of the Civil Code, the Seller's liability
under warranty for defects in Goods towards Customers who are not Consumers and are not PNPK (i.e., pure B2B transactions) is entirely excluded.

§ 13. Information on promotions and opinion verification (Omnibus)

  1. In the event of a price reduction of a Product, the Seller always displays information about the lowest price of that Product that was in effect for a period of 30 days before the reduction, alongside the reduced price.
  2. The Store presents product reviews. Review verification is carried out using the external TrustMate system, which sends an automated request to provide a review only to the Customer's email address after the order has been paid for and fulfilled. Reviews added in this way are marked as verified purchases.
  3. The Customer of the Online Store has the option to voluntarily and free of charge post a review regarding purchases made in the Online Store. The subject of the review may also include a rating, a photo, or a review of the product purchased in the Online Store.
  4. After purchases are made in the Online Store, the Seller transfers the data necessary to create an email invitation to the company handling the survey process. The sending of surveys and the process of collecting opinions in the forms are fully handled by TrustMate SA with its registered office at Bartoszowicka 3, 51-641 Wrocław. TrustMate SA sends an email to the Customer requesting a review and a link to an online form enabling its submission – the online form allows for answering the Seller's questions
regarding purchases, evaluating them, adding one's own description of the opinion, and a photo of the purchased product. If no review is submitted after receiving the first invitation to submit a review, TrustMate may resend the invitation.
  5. An opinion may only be given by a Customer who has made purchases in the Seller's Online Store.
  6. Opinions submitted by the Customer are published by the Seller in the Online Store and on the TrustMate.io profile.
  7. The submission of an opinion may not be used by the Customer for unlawful activities, in particular for activities constituting an act of unfair competition against the Seller, or activities infringing personal rights, intellectual property rights, or other rights of the Seller or third parties.
  8. An opinion may only be given for products actually purchased in the Seller's Online Store. It is forbidden to conclude fictitious/simulated sales contracts for the purpose of submitting an opinion. The author of an opinion may not be the Seller themselves or their employees, regardless of the basis of employment.
  9. A submitted opinion may be removed by its author at any time.

§ 14. Loyalty Program "LE SILQUE Club"

  1. The Store offers a free Loyalty Program called LE SILQUE Club for Customers with an active Customer Account. Creating an Account is equivalent to joining the Program.
  2. Rules for awarding points: Customers earn points, among other things, for making purchases. In the case of points awarded for purchases, they are calculated only on the final value of the purchased Goods (after deducting all discounts). Delivery costs are not included in the basis for calculating points. Points for a completed order are initially awarded with the status "pending". They become active and available for use after 14 days from the moment the Customer takes possession of the goods (i.e., after the statutory period for withdrawal from the contract has expired). In the event of withdrawal from the Sales Agreement (return of Goods), the pending points generated for those Goods are automatically cancelled. The Store may also award points for other activities (e.g., newsletter subscription, birthday), according to the information on the Customer's account.
  3. Using points: Collected points can be exchanged for rewards, free delivery, or discounts on subsequent purchases according to the exchange rates visible in the Customer Account panel.
  4. Validity of points: Accumulated points in the Loyalty Program are valid for a period of 12 months from the date of their assignment to the Customer's Account. Points not used within this period expire and cannot be restored.
  5. Accumulated points cannot be exchanged for cash or transferred to another Account.
  6. The Seller reserves the right to change the point exchange rates and the rules for awarding them. Customers will be informed of any changes with appropriate advance notice.

§ 15. Copyright and Intellectual Property

  1. All visual materials, texts, product photos, graphics, logos, and descriptions presented in the LE SILQUE Store are the intellectual property of the Seller or entities with whom the Seller has concluded appropriate agreements.
  2. Copying, distributing, or using these materials without the express written consent of the Seller is prohibited and protected by copyright law.

§ 16. Personal Data (GDPR)

  1. The Data Controller is the Seller. Data is processed, among other things, on the external servers of the Shopify platform. Details regarding the processing of personal data and the use of cookies are specified in the Privacy Policy.

§ 17. Final Provisions

  1. The content of these Regulations may be recorded by printing, saving on a medium, or downloading at any time from the Store's Website.
  2. Agreements with the Seller are concluded in Polish.
  3. In matters not covered by these Regulations, the generally applicable provisions of Polish law shall apply.
  4. In the event of a dispute arising from the concluded Sales Agreement, the parties will endeavor to resolve the matter amicably.
  5. The Seller informs the Customer, who is a Consumer, about the possibility of using out-of-court methods for handling complaints and pursuing claims. The Seller informs that at https://ec.europa.eu/consumers/odr/ there is an online platform for resolving disputes between consumers and entrepreneurs at the EU level (ODR platform).
  6. The Seller reserves the right to change these Regulations. All orders accepted by the Seller for processing before the effective date of the new Regulations shall be executed on the basis of the Regulations that were in force on the date the Customer placed the order. Changes to the Regulations come into effect 7 days from the date of publication on the Store's Website. The Seller will inform the Customer 7 days before the new Regulations come into effect about the change via an email message.
  7. These Regulations come into effect on May 20, 2026.
